General Terms and Conditions of Sale
These General Terms and Conditions of Sale (the « GTCS ») govern the provision of paid services (the « Paid Services ») by the operating company (« we » or « the operating company ») to any user of the website www.parisensuel.com (the « Site »), in accordance with the applicable laws and regulations in the User’s country of residence.
These GTCS supplement the General Terms of Use of the Site.
1. Scope and Acceptance of the GTCS
1.1 Scope
These GTCS apply to all Paid Services available on the Site.
Unless expressly stated otherwise, the GTCS apply to all users of the Site (a « User »), whether they are professionals, meaning any individual or legal entity acting within the scope of their commercial or professional activities.
The User must be at least 18 years old to register for and use the Paid Services available on the Site and hereby warrants that they have the capacity and authority to agree to the GTCS. If applicable, the User must also have proper authorization to represent the relevant entity. The operating company may implement an age verification procedure in compliance with applicable legal and regulatory requirements.
1.2 Acceptance
By purchasing any Paid Service, the User accepts these GTCS.
Acceptance of the GTCS by the User is confirmed by checking a box during the order validation process labeled « I accept the General Terms and Conditions of Sale » or through an explicit mention in the documentation related to the Paid Services.
The GTCS are available for download from the Site at any time and can be provided upon the User’s request.
2. Registration
Before subscribing to a Paid Service, any User must create an account either by completing the registration process available here or when publishing their Advertisement.
Each User guarantees the accuracy, sincerity, and reliability of the information provided.
By registering on the Site, the User agrees to provide the operating company with documentation proving the creation and legal existence of the business in which the promoted services will be performed. This document will be an official business registry extract (e.g., K-Bis in France) including the establishment’s registration number or an equivalent official document.
3. Advertisements
Each User acknowledges that there may be a delay between the publication of an Advertisement and its display on the Site.
The User declares that their Advertisement complies with the Terms of Use, these GTCS, and all other applicable legal or regulatory provisions.
Specifically, the User acknowledges and certifies that:
The content of their Advertisements complies with the applicable professional regulations;
They are the author of the text, drawings, and photographs accompanying the Advertisement. Otherwise, they possess all necessary rights, particularly intellectual property rights, and authorizations required for the Advertisement’s display and the conclusion of this contract. Therefore, any Advertisement published on the Site is the sole responsibility of the User.
For practical purposes, the User grants the operating company all rights, including intellectual property rights, necessary for the operating company to properly execute the Paid Service in accordance with the Terms of Use.
The operating company reserves the right to remove or block access to any Advertisement that does not comply with the Terms of Use, infringes on third-party rights, is illegal, or does not comply with applicable law, without compensation or refund.
4. Paid Services
Paid Services include various offers ensuring different levels of visibility for the User’s Advertisements.
These offers are provided for an indefinite period, billed monthly or quarterly. Prices are expressed in euros, excluding taxes, and may be revised at the start of each calendar year.
Paid Services are subscribed to for an indefinite period. Users can terminate their subscription by notifying the operating company before the 10th of the current month, effective at the end of that month.
Each Paid Service applies to a single Advertisement and cannot be transferred to another User. Multiple Paid Services can be subscribed to simultaneously.
Upon order confirmation, the operating company will send an invoice and payment receipt with all order details. Users explicitly agree to receive electronic invoices.
Paid Services are non-refundable and are immediately usable upon subscription.
5. Price and Payment Methods
Prices are quoted inclusive of all taxes in France and the European Union. Payments are made via credit card, PayPal, etc.
Payment data is not stored by the operating company or the financial transaction processor. Payment processing is immediate.
Personal data provided during the order and payment process undergoes automated data processing to analyze transactions and prevent fraud.
The operating company complies with applicable anti-money laundering laws and due diligence regulations. Users must ensure their provided information is accurate and declare that the funds used are not derived from any criminal or illegal activity.
6. Termination by the User
Any User may terminate or modify their services at any time:
Advertisements: The User can delete an Advertisement directly from their personal account. Deleting an Advertisement does not terminate any related options. If the User reactivates the Advertisement, associated options remain valid if still applicable.
Account Termination: To terminate their subscription, the User must deactivate their account. Once the termination process is complete, it is immediate, and all remaining Advertisements become unavailable. By deleting their account, the User acknowledges that they forfeit any Paid Services purchased before the account deletion. Paid Services are billed until the end of the current month if the termination occurs before the 10th; otherwise, billing extends to the end of the following month.
7. Termination by the Operating Company
The operating company may, at any time and without prior notice or refund, delete or deactivate a User’s account, block their email or IP address, terminate access to the Site and/or Paid Services, or remove content if the User violates any clause of these GTCS or the Terms of Use. This includes violations related to third-party rights, applicable laws, or if the operating company is legally required to do so. For instance, an Advertisement linked to illicit activities such as prostitution may be removed.
The User acknowledges that the operating company will fully cooperate with law enforcement authorities investigating system or network security breaches or suspected criminal offenses.
To the extent permitted by law, the operating company is not liable to the User or any third party for the above actions. The User agrees not to attempt to use Paid Services after such termination. The operating company is not responsible for any failure or delay in removing illicit content, and the User waives any related claims against the operating company.
8. Controls by the Operating Company
The operating company has implemented a « mystery client » practice to anonymously verify compliance with these GTCS and ensure no sexual services are offered. The User unreservedly accepts this practice as part of good faith execution of the GTCS.
The operating company also systematically cross-checks phone numbers used by the User and monitors comments about the User’s establishments on other websites or media.
Upon request, the User must provide details of procedures ensuring no sexual services occur within their establishments. Failure to comply may result in account termination by the operating company.
The operating company processes and stores data in the United States. Data transfers to other jurisdictions comply with applicable laws and contractual safeguards, including Standard Contractual Clauses. European Union, Swiss, and UK residents’ data is processed under the GDPR and Data Privacy Framework principles.
9. Liability
The operating company is not liable for any failure or delay in fulfilling its obligations under these GTCS due to the User, a third party, or force majeure.
Subject to applicable laws, the User agrees that the operating company’s liability is limited to the amount paid for Paid Services in the six (6) months preceding the claim. The operating company is not liable for any indirect damages resulting from the User’s Site use.
10. Intellectual Property
Trademarks and trade names used on the Site belong to the operating company, its affiliates, or partners unless otherwise stated. Except for User-uploaded content, the operating company owns or controls all intellectual property rights on the Site and its content. Users may not reproduce, distribute, or reuse any part of the Site’s content outside what is explicitly authorized or required by law.
11. Force Majeure
The operating company is not liable for any failure or delay in fulfilling its obligations due to events beyond its control.
12. Severability
If a court deems any GTCS clause invalid or unenforceable, the remaining provisions remain in effect unless an essential clause is invalidated.
13. No Waiver
Failure to enforce any provision does not constitute a waiver of that or any other provision.
14. Updates to the GTCS
The GTCS may be updated by posting new versions on the Site. The updated GTCS apply to new Paid Services purchased after the publication date.
15. Governing Law and Jurisdiction
All relationships between the User and the operating company are governed by applicable law, regardless of conflict-of-law rules.
Any legal action shall be brought before a competent court, without prejudice to the right of the operating company to pursue legal action in any other jurisdiction where permitted by applicable law.
